In Queensland, commercial building owners who sell or dispose of a building that may contain asbestos are required to take certain steps to ensure the safety of workers and others who may be at risk of exposure to asbestos. Under the Work Health and Safety Regulation 2011 (WHS Regulation), a PCBU or "persons conducting a business or undertaking" must provide an asbestos register and management plan to the new owner and/or occupier of the building if it's suspected that the building contains asbestos. Many older buildings constructed prior to 2003 still have asbestos-containing materials (ACMs) present today. A PCBU may be exposed to fines and other legal repercussions if it fails to provide an asbestos register as required by the WHS Regulation. It is crucial to be aware of your legal responsibilities and to take the required actions to make sure that the workplace is compliant with all applicable rules and laws. My workplace building was built in 1999, should I get an asbestos audit? It is generally recommended that buildings constructed before the mid-1980s be assumed to contain asbestos-containing materials (ACMs) until proven otherwise. However, it is possible for buildings constructed after this time to also contain ACMs, as asbestos was not banned in all construction materials until 2003 in Australia. If you are a person conducting a business or undertaking (PCBU) and you are responsible for managing asbestos in the workplace, you may want to consider getting an asbestos audit if your building was constructed before 2003 and you are not sure whether it contains ACMs. An asbestos audit is a systematic inspection of a building to identify the presence, location, and condition of ACMs. An asbestos audit can provide valuable information about the presence and condition of ACMs in the building, which can help you to manage the risks associated with asbestos and protect the health and safety of workers and others who may be exposed to asbestos. If ACMs are found, you may need to develop an asbestos management plan and take other steps to control the risks associated with asbestos, such as sealing or enclosing ACMs, providing personal protective equipment (PPE), or establishing exclusion zones. Super Six asbestos sheeting was widely used in Australian construction from 1950’s to the mid 1980's, after which it was replaced by a very similar looking asbestos-free product, known as Hardifence. Many properties constructed in that era still contain Super Six fencing and roofing, and it can be difficult to differentiate the two.
